Possible Lemon-09 SEL

I have started the "lemon Law" process on my 09 SEL with 4800 miles. It has been at the dealership for service twice in the past month because the engine will surge when coming to a stop ,sometimes nearly stalling, and the Check Engine light comes on. both times, they replaced a VCT solenoid as per a TSB. It is fine for a week, and then happens again. Now its just happened for the third time yesterday. According to NJ Div on consumer affairs, Im supposed to write a letter to Ford giving them one more chance to repair before they either replace or refund. I really just want it fixed because its getting really annoying. has anyone here dealt with Ford under these circumstances before?

Hi anpbabaki. :D When you purchased your car, you were given a handful of paperwork and booklets. Along with the Owners Manual, you were also given a "Warranty Guide". In that Warranty Guide is a detailed explanation of what you need to do to to initiate "Lemon Law" procedures.

 

Along with the advice you received from Consumer Affairs, I would strongly advise that you find the Warranty Guide and read it. If you do not follow the proper procedures, you can jeopardize some of your rights.

yup i have read it, and it states the same thing, that a letter must be written to Ford stating the issues so they may try and repair it a final time before pursuing legal action. Thats the letter I will be sending tomorrow.

Before you burn any bridges there a couple of things you need to do.

 

Number 1: Would be don’t go beating up the service dept. (when the lawyers show EVERTHING changes)!

Set up an appointment with your service advisor.

He is a professional so you should conduct yourself as you would in your profession.

Have him check to see if the same tech worked on the problem every time,

sometime a NEW set of eyes will see the problem immediately, again be diplomatic.

 

Number 2 have you looked up YOUR states Lemon law.

Example:

My state has a specific number of failed attempts

BUT IT ALSO has a NUMBER of out of service days (something like 30 for the same problem) and several other items that MUST be done/met before we qualify as a lemon.

 

Good luck hopefully your problem will be resolved

My service guys are great Ive been dealing with them for a long time, I plan on visiting the manager this morning, but Im still sending the letter to cover my butt. My state is NJ and the law says EITHER an issue that is not resolved after 3 repair attempts OR the car is out of service for 20 days or more within the first 2 yrs/18K miles as is in my first post.

Im just really disappointed because this is my fourth ford vehicle since 1999 and i have never had issues like this. ive always had Explorers but i absolutely love the Edge.

I would also suggest giving Ford one last chance to fix the problem - at another dealer! In most cases it's simply a case of the technician either making the wrong diagnosis or not having the right equipment. If they replaced the exact same part twice within a week that's usually a sign of poor troubleshooting. The chances of the same part failing twice within a week are astronomical. That usually means the original diagnosis was wrong.

 

Talk to the service mgr and if necessary try another dealer. You don't have a lemon - just a hard to fix problem.

i agree its a problem that most likely has a solution but they are the only service center near me thats why i go there. They have it now so we'll see what happens. Whether or not its a "lemon" I still should not have to go through this on a new vehicle. Im a patient person and I'm not looking for any compensation or anything like that I just want it fixed ya know? The letter to Ford is just to cover myself and to have it documented with them.

 

Another problem is that the light comes on on Saturday, and there are no svc centers open on the weekend anywhere near me, and by the time Monday comes the light is off already, but they should be able to see the code history in the computer.

I didn't mean to imply that you don't have a problem or that you shouldn't pursue your options. I just meant that you have a single problem that, once fixed, probably won't reoccur. As opposed to a real "lemon" where you have multiple problems that are likely to keep reoccuring.

 

I'd be a little more patient getting a single problem fixed than I would for a true multi-problem "lemon'.

Update:

 

I have now brought my car to Ford for a 4th time for the same issue. Driving home for lunch today, pulling up to my house, engine started to surge and check engine light came on. I immediately brought it to the dealer and they have an appointment setup for Friday to look at it again. I have also been in contact with Ford customer care, and their legal department has called me back, they are sending a field tech out on Friday when I bring the car in.
